Component District BOCES DS Salary Cap Letter
Dear Governor Cuomo,
On behalf of the XXXX BOCES Board of Education, we are writing to ask for your approval of S.3203-A/A.2112-A, which would update the cap on BOCES district superintendent salaries.
Currently, a BOCES district superintendent salary is capped at 98% of the commissioner of education’s 2003-04 salary or 106% of the previous year’s salary, whichever is less.. This legislation would update the cap to 98% of the commissioner’s 2018-19 salary. As drafted this legislation retains the 6% year over year cap.
Our district superintendents play a critical role in helping shape and implement important education policies that directly impact our students. District superintendents are by statute, the education leader for their BOCES, their component districts and their communities. According to the State Education Department, the role of the district superintendents has been defined as: education change agent, regional planner and coordinator and field representative for the New York State Education Department- a key liaison between the state and local component districts. They are regularly called upon to advise the State Education Department, weigh-in on pending policy changes and share feedback from their component districts. BOCES provide a wide array of services to school districts across the state, including emerging career and technical education, special education programs and a variety of non-instructional services designed to help improve local school district efficiencies.
As a board, we are responsible for recruiting and hiring district superintendents. We are also responsible to our CEO to create an environment where, if he or she is high performing, he or she wants to stay. However, unlike our component boards, we are limited in our ability to negotiate a competitive compensation package with our top employee. Because it has been 15 years since the cap was increased, and many of the superintendents leading the 37 BOCES around the state have significant experience, many have already reached the cap.
