Shared decision-making committees cannot restrict BOE's hiring

Pursuant to commissioner's regulations, every school board and BOCES must have in place a plan that specifies the types of educational issues that will be subject to a school-based planning and shared decision making process. What kinds of issues are - and are not - appropriate for shared decision-making?

Although commissioner's regulations do not answer that question, rulings from the commissioner of education have made clear that there are some which cannot be delegated to a shared decision-making team for a final decision. These include, for example, formulation of the school budget and what instructional programs will be offered.
